Will Disputes

Whether the claim is undue influence or lack of mental capacity, will disputes can be complicated and protracted matters requiring the expertise of attorneys who practice in this area of law. Nina Weiss has represented both beneficiaries as well as executors in numerous will disputes and knows what it takes to achieve a successful outcome.

Similar to guardianship, this is an enigmatic area of law in which subject matter expertise is critical.  This particular area of law involves shifting of burdens and heavy reliance by the courts on well established case law.  We at Weiss Law have this expertise.

We also have compassion.  These types of cases can be especially difficult since they may involve long standing conflict between siblings and others as well as strong emotional feelings of loss, rejection and resentment. Litigating these types of cases can have the real potential of adding to family conflicts and polarizing the members of a family even further. Because of her extensive experience and knowledge, NinaWeiss is able to exercise the proper balance of compassion and sensitivity for what the family is going through yet is also a zealous advocate in the litigation process.
